Court: Cuffed detainee who kicked officer in the head could be jailed

A CUFFED detainee who kicked a police officer who was driving him along the M18 to custody — causing the driver to lose control of the car — has been warned he could be jailed.

Brady Stoner (23), of Nelson Road, Maltby, kicked a police officer in the head from the back seat of a police car in September, Sheffield Magistrates’ Court heard on Tuesday.

The assault caused the officer to lose control of the car and he had to pull into the hard shoulder to get assistance, Michelle Smith, prosecuting, told the court.

She said Stoner had been cuffed and was sitting in the back of the car at the time.

“He was transported to custody in a van,” said Ms Smith.

“At the custody suite, he further assaulted a PC Gillies by emptying his nostrils on to his leg and waist area.

“He also failed to give a breath test when required.”

Ms Smith said four “incomplete” breath samples were taken from Stoner.

“He refused to provide further samples,” she said.

Stoner refused to comment when he was interviewed by the police.

He pleaded guilty to two charges of assaulting a police constable in the execution of his duty and one offence of failing to provide a specimen.

District Judge Mr Paul Healey said: “He [Stoner] is in real risk of an immediate prison sentence.

“An assault on any police officer is serious but kicking them in the head, while someone’s driving a police car on the motorway, is very serious.

“All options are going to have to be kept open.”

Stoner was given an interim disqualification from driving and was released on unconditional bail.

He is next due to appear at Sheffield Magistrates’ Court on June 4.
