Rotherham filling station damages claim thrown out

A WOMAN who broke her knee in a fall at a Rotherham supermarket has lost her lengthy battle for compensation.

Susan Lupton (57), from Doncaster, suffered the injury when she slipped at the Morrisons filling station in Bramley in 2008.

She claimed the fall was caused by a diesel spillage and was backed up by a paramedic who said the ground had been black and slippery, although garage staff said there had been no spillage.

But Mrs Lupton’s claim was thrown out at Sheffield County Court last year and that decision has now been backed by Lord Justice Elias at the Court of Appeal.
