Obviously it’s important to ensure you select the appropriate pension option because once accepted there’s no alterations allowed. Without Andy Binns (IFA) of “My Pension Expert” Doncaster’s intervention in February 2012, Aviva would have cheated me out of transferring my pension fund and entitlements.

Regrettably I suspect losing one case won’t deter Aviva from continuing with their “might is right” cavalier attitude towards policy holders who don’t have access to the expertise to fight their case. Aviva had the audacity to tell me “it was illegal to transfer my fund” and after I’d used the Freedom of Information Act to gain access to my files, “nobody ever wins against Aviva by taking their claim to the Ombudsman”. Well I proved them wrong. It’s hard to believe I’m the only person with a Guaranteed Minimum Pension (GMP) section 32 pension policy to suffer these deceitful tactics practiced by Aviva.

All I wish to achieve by publishing my case is to forewarn others. I’ve contacted the appropriate government department suggesting rule changes to prevent these underhand practices without success.

After winning my case I presented the ombudsman’s judgement to politicians asking for support to no avail. The only local politician to make a proactive contribution was Cllr Caven Vines, leader of UKIP, Rotherham’s official opposition. After contacting Caven, he immediately brought my concerns to the attention of Gareth at the Advertiser who subsequently publicised his June 20 2012 report.

My appreciations go to Gareth, the Advertiser and a special thank you to Caven, a man who walks his talk and fulfils his promises. Let’s hope by publishing my case it will prevent someone else suffering the distress of being cheated out of what effectively is their own money and entitlements.
